Service Terms and Conditions

These service terms and conditions ("Service T&C") govern the services ("Services", as defined below) provided by Alta Booking Limited through Alta Booking's Platform (as defined below). Please read them carefully as they contain important information pertaining to your rights and obligations.

In addition to these Service T&C, the use of the Platform is subject to the Website T&C (as defined below), and the Privacy Policy (as defined below) which informs you about the processing of the personal data you provide. In addition, any reservation or purchase of services through the Platform may be subject to additional Suppliers' Own T&C (as defined below).

1. Definitions

Alta Booking: Alta Booking Limited, company number 11652479 whose registered office is at 114 St. Martin's Lane, Covent Garden, London WC2N 4BE.

App: Alta Booking's iOS and Android mobile application.

Customer: Any person who uses Alta Booking's Platform and receives Services.

Platform: The Website, the App and any other means of communication by which Alta Booking makes the Services available.

Privacy Policy: Alta Booking's privacy policy is available here.

Services: The online reservation and purchase system regarding various services as made available from time to time by the Suppliers on the Platform, including the facilitation of related payments. The services that you may reserve or purchase via the Platform are made available by the Suppliers and Alta Booking acts as a travel agent.

Supplier's Own T&C: The terms and conditions of a Supplier in particular which apply to a Service.

Supplier(s): The supplier of services as available on the Platform from time to time. Suppliers may be for instance a hotel, a car rental company, or any other provider of services.

Service T&C: These terms and conditions regarding the Services as amended from time to time.

2. Scope, Applicability and Changes

Scope: These Service T&C govern your use of Services available on the Platform together with the Website T&C, Website Acceptable Use Policy and the Privacy Policy.

Applicability and Consent: By using Alta Booking's Services via the Platform, you acknowledge and agree to the Service T&C. Your use of the Services is conditional upon your agreement and if you do not agree with any provision of the Service T&C then you are not allowed to use the Services.

Changes: The Service T&C are applicable in the current version at the time of your use of the Services. Alta Booking may change the Service T&C at any time. The current version of the Service T&C is available here

3. The Services

Services: The Services consist of the operations of the Platform, payment processing, and further related intermediary services (such as data processing, transfer of related information, etc., in accordance with the Privacy Policy). Alta Booking acts as a travel agent when providing the travel services offered on the Platform. Alta Booking may change or discontinue the Services or any parts thereof at any time at Alta Booking's sole discretion.

Platform Operation: Alta Booking operates the Platform as an online platform on which Suppliers can advertise and make available their services to you for reservation or purchase.

Suppliers: You acknowledge and agree that the contract for the supply of services as a result of your use of the Platform will be between you and the relevant Supplier pursuant to the Supplier’s Own T&C and that Alta Booking is not a party to such contract and is only acting as a travel agent for some of the services on the platform.

Data Transfer/Processing: Alta Booking will collect, process and transfer the data related to your reservation or purchase to the Supplier / Service Partner / Service Provider and transmit any related correspondence (e.g. such as a confirmation from or on behalf of the Supplier / Service Provider) in accordance with the Privacy Policy.

Registration: You may choose to register on the Platform to facilitate future reservations or purchases. If you do so, you are obligated to provide complete, accurate and truthful information and to update this information in the event it might change (e.g. address, telephone number, e-mail address, etc.). Alta Booking may, at any time, block or terminate your access to the Platform if Alta Booking suspects that you have provided incorrect or incomplete information.

Your Access Data/Login: You are responsible for the safekeeping of your login details and you must keep this data confidential. All actions taken under your login details will be deemed as taken by you. If you suspect misappropriation or misuse of your access data, you must notify Alta Booking immediately.

Customer Reviews: The Platform includes a reviewing platform, upon which you may post public reviews about your experiences with Alta Booking, the Supplier, the Service Partner / Service Provider and the services (“User Reviews”). You are encouraged to complete User Reviews to provide your feedback on Suppliers / Service Partners / Service Providers so that they could improve their services. Suppliers / Service Partners / Service Providers will be responsible for replying to User Reviews. We require such replies shall be polite and professional and may be subject to review, amendment or removal by Alta Booking. However, if the Supplier / Service Partner/ Service Provider, acting reasonably, feels that any User Reviews of the Supplier / Service Provider / Service Partner or any person or in some other way is an infringement of any person’s legal rights, the Supplier / Service Provider / Service Partner may flag and report that User Review to Alta Booking, which may then in its sole discretion take any action it deems necessary or desirable.

4. Specific Services by Suppliers

Alta Booking operates the Platform, which acts as an interface between Customers and Suppliers with respect to offering and supplying all services.

All Suppliers are under a contractual obligation to provide services that are in conformity with their contract with us.

All services shown on the Platform are subject to availability and the images and/or descriptions of the services on Platform are for illustrative purposes only and actual services may vary from those images and/or descriptions. We require Suppliers to ensure that all information provided by them for display on their page of the Platform is accurate, complete and not misleading in any way but we cannot verify the information which they provide to us. It will be each Supplier's responsibility to ensure that all of its services listed on the Platform are available and accurately described, and Alta Booking will not be liable for any losses resulting from any such inaccuracies.

It is your (or the person receiving the services) sole responsibility to communicate in advance any medical or health-related conditions and/or special needs to the Supplier that might affect or be affected by any services (for example without limitation, allergy information and health issues). If you (or the relevant recipient of the services) fail to disclose any such information to the applicable Supplier, neither Alta Booking nor the relevant Supplier shall be liable to you (or the recipient of the services) for any injury, loss or damages resulting from such services that could reasonably have been avoided if you (or the recipient of the services) had disclosed that information prior to receiving the services.

5. Reservation / Purchase Process

No Offer: All information displayed on the Platform regarding the services and the products do not constitute an offer of sale.

Reservation / Purchase Request: By choosing a service displayed on the Platform and by submitting a request for a reservation or a purchase to Alta Booking, you invite Alta Booking to process the corresponding request.

Confirmation and Conclusion of Contract: a legally binding contract is entered into between a Customer and a Supplier / Service Partner / Service Provider once the confirmation notice is received by the Customer.

6. Fees, Prices and Taxes

For the Services: The Services, including the provision of the Platform and its access thereto, are free of charge (other than where the Customer pays for services by credit card), with the exception of the handling of change and cancellation requests for which Alta Booking may impose an administration fee as set out in clause 8. Suppliers pay Alta Booking a commission being a small percentage of the reservation fee or purchase price for any services which Customers reserve or purchase via the Platform.

Change / Cancellation Fee: Alta Booking may impose an administration fee as set out in clause 8 for the handling of change and cancellation requests.

Alta Booking's Right to Cancel: Alta Booking reserves the right to cancel your change request or reject your cancellation request if any applicable change or cancellation fees are not paid as stipulated on the Platform.

Currency: All fees and prices displayed on the Platform are in Pound Sterling (GBP) or in another currency (e.g. EUR), depending on the Supplier's country of residence. The actual amount that is charged may slightly differ due to varying exchange rates applied by different credit card issuers. The fees and prices may be exclusive or inclusive of local taxes and other taxes (such as VAT).This will depend on where the services are being provided.

Credit Cards: Alta Booking may charge a fee of 3% in respect of payments made by the Customer for services via the Platform to cover the costs borne by Alta Booking in respect of such payments as charged by credit card issuers.

7. Terms and Conditions of Use

Conditions of Use: The Services and the Platform are provided for your personal, non-commercial use only, subject to the terms and conditions set out in these Service T&C. Your right to access and use the Platform is conditional upon your compliance with these Service T&C.

Your Age: You may not use the Services unless you are at least 18 years of age.

Authorisation: If you are making a reservation or a purchase on behalf of a third party (e.g. other people travelling with you) or on behalf of a legal entity, you must first obtain their consent, or their respective authorisation, to do so and you hereby represent and warrant that you have obtained such consent or authorisation, and such third parties or legal entities acknowledge and agree to these Service T&C.

Access: The Services, including any information contained on the Platform or services made available thereby, does not target any person in particular who is subject to any regulation that has the effect of restricting the access, the use of any information, or the Services made available on the Platform. In the event you are subject to such limiting regulation, you are not permitted to access or use the Platform.

Errors / No Assurance: The information regarding the services available on the Platform is provided by the Suppliers or the relevant Service Partners / Service Providers as the case may be. Although Alta Booking will take reasonable measures to display reliable, accurate and complete information about the services displayed on the Platform, Alta Booking does not warrant that such information is reliable, accurate or complete Alta Booking will not be liable for any errors, misunderstandings, inaccuracies, misleading or untrue information; or failure to provide information. Alta Booking reserves the right, for itself and on behalf of Suppliers / Service Partners / Service Providers, to correct any errors, including pricing errors, both on the Platform as well as regarding pending reservations or purchases made under erroneous pricing information.

Pictures and Illustrations: Pictures and illustrations of the services displayed on the Platform are for informational purposes only.

Information: Suppliers / Service Partners and Service Providers are fully responsible for the accuracy, completeness and correctness of the information displayed on the Platform related to the services provided, including the availability, rates and prices, and Alta Booking has no responsibility or liability relating thereto.

No Recommendation: Unless expressly stated otherwise on any case, the services appearing on the Platform do not amount to nor should be regarded as a recommendation or endorsement by Alta Booking regarding the quality, service level, qualification, rating or other certification of quality of any Supplier / Service Partner / Service Provider (or their facilities, venues, services).

Disclaimer: The Platform is provided on an "as is" and available basis and Alta Booking cannot be held liable for any interruptions, breakdowns or non-accessibility of the Platform or some of its functionalities. The use of the Platform is at your own risk. Alta Booking may limit or block your access to the Platform at any time, at Alta Booking's sole discretion. Alta Booking may also, at its sole discretion, refuse to enter into any kind of contractual relationship with you at any time and for any reason.

Prohibited Uses: You may not use the Platform for commercial purposes, unless you have obtained Alta Booking's prior written consent. You may not use the Platform in any unlawful, infringing or offensive manner.

Indemnification: You agree to indemnify, defend and hold harmless Alta Booking, its officers, directors, employees, agents, affiliates, licensors, Suppliers / Service Partners / Service Providers and any third party information providers to the Platform from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Service T&C by you.

Limitation of Liability: Nothing in these Service T&C shall limit or exclude Alta Booking’s liability for:

    • death or personal injury caused by its negligence, or the negligence of its employees;
    • fraud or fraudulent misrepresentation; or
    • breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982.

    Subject to the above sub-clause

    • Alta Booking shall not be liable to the Customer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods; or, loss of contract, or loss of use or, loss of corruption of data or information whether direct or indirect or, any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses arising under or in connection with the Services provided by Suppliers/ Service Partners / Service Providers; and
    • Alta Booking’s total liability to the Customer in respect of all other losses arising under or in connection with the Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to a maximum of three times the cost of a service booked.
  • Unless expressly provided otherwise, all your rights and remedies are against the Supplier or the relevant Service Partner / Service Provider, and your contract for the supply of services is made with the relevant Supplier / Service Partner / Service Provider only. Alta Booking acts as an interface between the Customer and the Supplier / Service Partner / Service Provider.
  • You acknowledge that any contract entered into by you with any Supplier / Service Partner / Service Provider is an independent contract. Alta Booking hereby disclaims any and all liability for any act or omission of any Supplier / Service Provider / Service Partner or any loss incurred by you as a result of any act or omission of a Supplier / Service Provider / Service Partner whether or not arranged through the Platform.
  • Alta Booking shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from purchases or requests or any instructions supplied by you which are incomplete, incorrect or inaccurate or arising from their late arrival or non-arrival, or any default by you.
  • Alta Booking shall not be liable to you or be deemed to be in breach of these Service T&C by reason of any delay in performing, or any failure to perform, any of Alta Booking’s obligations in relation to the Services, if the delay or failure was due to any cause beyond Alta Booking’s reasonable control.
  • Except as expressly set out in these Service T&C, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from these Service T&C.
  • This clause 7 shall survive termination of these Service T&C.

8. Change / Cancellation Requests and Fees / Refunds

Contact: Any change or cancellation request of an order which has already been processed by a Supplier / Service Partner / Service Provider shall be made via the Platform or by email to support@altabooking.com or by calling Alta Booking at +44(0)204-586-0592.

Request Handling: All change and cancellation requests will be handled by Alta Booking and will be subject to your legal rights in the particular territory, this Service T&C, and the Supplier’s Own T&C or the terms and conditions of the relevant Service Partner / Service Provider as the case may be.

Change / Cancellation Fee:

    • In addition to your other legal rights, you may in certain circumstances have the right to cancel a contract with a Supplier / Service Partner / Service Provider and receive a refund or a credit note.
    • Cancellations must be made by one of the following methods:
      • using your account via the Website or by using the App; or
      • following the link in your booking confirmation.
    • The Supplier / Service Partner / Service Provider or Alta Booking shall be entitled to retain the full cost of the service booked by you (or be paid if a prior payment has not yet been made by you). Alternatively, the Supplier / Service Partner / Service Provider or Alta Booking shall be entitled at their discretion to refund a portion of the cost of the service booked by you.
    • If a change or a cancellation is permitted by the relevant Supplier's Own T&C or the terms and conditions of a Service Partner / Service Provider, an administration fee for Alta Booking's handling of the change / cancellation request will be applicable in addition to any change / cancellation fees imposed by the Supplier / Service Partner / Service Provider.

Alta Booking's Right to Cancel: Alta Booking reserves the right to cancel your change or cancellation request if any applicable change / cancellation fees are not paid in a timely manner.

9. General Travel Provisions

Travel Advice: Alta Booking recommends that you inquire about any travel prohibitions, warnings, announcements and advisories issued by relevant country’s governmental department displayed on their website prior to planning a trip to a foreign destination.

No Representation: The operation of the Platform and performance of the Services do not constitute and shall in no way be deemed to constitute any representation or warranty that travelling to any destinations displayed on the Platform is advisable or risk-free, and Alta Booking shall not be held liable for any damages or losses incurred from travelling to such destinations.

Insurance: Unless explicitly stated, the services available on the Platform do not include any insurance, such as travel insurance. Alta Booking recommends that you enter into a suitable insurance contract in order to cover, in particular, the costs incurred in the event you cancel your trip and costs related to emergency medical assistance, including repatriation.

10. Intellectual Property Rights

Ownership: All copyright, trademarks and other intellectual property rights in all text, images and other materials on the Platform are owned (or licensed) by Alta Booking, the Suppliers / Service Partners / Service Providers, or the respective owners. No copying is authorised.

No Transfer: Nothing in these Service T&C shall be construed as the transfer of or the granting of any right, material, or information whatsoever, of the Platform's intellectual property rights, otherwise as expressly provided below.

Permission to Use: You are permitted to use the Platform for your personal, non-commercial use only, for the purpose of viewing the services displayed on the Platform and, if you so choose, to reserve or purchase such services via the Platform, provided that you comply fully with these Service T&C.

11. Miscellaneous

Applicable Law: These Service T&C and any dispute or claim arising out of them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law.

Jurisdiction: The Customer agrees that the English Courts shall have jurisdiction to hear and determine any dispute (including non-contractual disputes or claims) arising from the interpretation of these terms. However, the Customer may bring legal proceedings in Scotland or Northern Ireland if that is where the Customer resides.

Alternative Dispute Resolution: Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to contact an alternative dispute resolution provider, such as the European Commission Online Dispute Resolution platform which can be accessed via the following link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage

Force majeure: If the performance of any duty or obligation under these Service T&C by Alta Booking or the Customer is prevented, restricted, interfered with, or delayed in any way due to any cause that is beyond the reasonable control of the party liable to perform, unless conclusive evidence to the contrary is provided, the party so affected shall, upon giving written notice to the other party, be excused from such performance and shall not be liable to the extent of such prevention, restriction, interference or delay. The affected party shall use its best efforts to avoid or remove such causes of non-performance and shall promptly continue performance whenever such causes are removed.

Severability: If any provision of these Service T&C is or becomes invalid, unenforceable or non-binding, the other provisions shall remain in full force and effect. In such event, such invalid provision shall nonetheless be enforceable to the fullest extent permitted by law and any invalid part of such provision shall be replaced by a substitute provision as closely approximating the original provision reflecting the commercial intention of the parties.
